David Flick, Principal and Founder, announces the firm has successfully obtained a four-year extension on the Clean Water Act (CWA) Section 404/401 Individual Permit for the Hedge 175 commercial development in Olathe, Johnson County, Kansas.
Extensive time and money was invested by the development group for receipt of the CWA Section 404/401 Individual Permit authorization from the US Army Corps of Engineers and the Kansas Department of Health and Environment. Most Individual Permits authorize impacts to jurisdictional surface waters for a permit period of 5 years; however, due to the current real estate downturn, many commercial projects have been delayed. Terra Technologies, has spent considerable effort to ensure that the investment made in obtaining the 404/401 Individual Permit for the Hedge 175 Project is maintained.
The Corps of Engineers conducted a site inspection of the commercial project prior to granting the multi-year permit extension to ensure compliance with the original permit conditions. The extension preserves the original compensatory mitigation requirements for on-site restoration of an impaired stream channel and its adjacent riparian corridor. Mitigation efforts will include installation of Newberry-riffles when the stream channel for grade control and to improve in-stream habitat, construction of a prairie eco-basin BMP, and restoration of riparian vegetation with native species of trees, shrubs, grasses, and forbs.
