Terra Technologies Completes Management Of 80 Clean Water Act 404 Permits

Between October and December 2010, staff at the Leawood, Kansas office of Terra Technologies processed 80+ permit activities on behalf of our clients in compliance with general, regional, and provisional permit conditions. This is part of our commitment to assist our clients throughout the entire permit process, not just during the application phase.

 

When submitting for a Clean Water Act Section 404/401 permit, our firm becomes the Registered Agent representing the interests of the applicant. As such, we monitor the current status of the permit and issue reminders to our clients regarding permit expiration and provisional requirements related to compliance with permit conditions.

 

Many of these permits expire within two years of issuance. Others expire nationally on the same day. More extensive Individual Permit authorizations can be valid for 5+ years.

 

 

Prior to permit expiration, we notify the appropriate Army Corps of Engineers representative and communicate one of the following characterizations;

 

  • Work is complete and a compliance certificate will be provided at a later date;
  • Work is complete and documentation supporting provisional compliance will be submitted at a later date;
  • Work is on-going and permit requires reverification or extension;
  • Work was not initiated;
  • Work was likely initiated but applicant is unresponsive

 

In each of these instances, post-construction submittals are required to the Corps of Engineers. Applicants will receive correspondence from our firm requesting advisement of project status.
